PRIVACY POLICY​

The Developer (DV) of Delving Deep values your privacy and your rights to control your own personal data; for these reasons, the Delving Deep (DD) App does not collect any personal data, period.   

TERMS OF USE (AGREEMENT)

​By accessing and using DD App(s), you are confirming that you understand English well enough to understand and agree to each of the terms and conditions set forth herein ("Terms of Use"). Additional terms and conditions if or where applicable to specific areas of the DD App(s) or to particular content will be posted in particular areas of the DD App(s) and, together with these Terms of Use, govern your use of those areas, and content. These Terms of Use, together with applicable additional terms and conditions, are referred to as this "Agreement". 

You may not use the information, writings, images and/or other works that are produced within the DD App(s) (singly or collectively, the “Content”) for your commercial or personal purposes without the expressed written consent from the DV. No right, title or interest in any Content is transferred to you, whether as a result of downloading such Content or otherwise. You may not use, alter, copy, distribute, transmit, or derive another work from any Content obtained from the DD App(s) or site.

The DV reserves the right to modify this Agreement at any time without giving you prior notice. Your use of the DD App(s) following any such modification constitutes your Agreement to follow and be bound by the Agreement as modified.

COPYRIGHT

​The DD App, site, and the Content they contain, are the property of the DV; and are protected from unauthorized copying and dissemination by copyright law, trademark law, international conventions and other intellectual property laws. ‘Delving Deep’, the Delving Deep word-mark and logos are pending trademark registration and belong to the DV exclusively. You agree not to display or use, in any manner, the Delving Deep trademarks, without prior permission and consent from the DV.

DISCLAIMER OF WARRANTIES

THE DEVELOPER (DV) MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE DD APP(S) OR THE CONTENT. THE DV EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE SITE, THE CONTENT, AND ANY PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED VIA THE SITE. THE DV DOES NOT WARRANT THAT THE FUNCTIONS PERFORMED BY THE DD APP(S) WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS IN THE DD APP(S) WILL BE CORRECTED. THE DV DOES NOT WARRANT THE ACCURACY OR COMPELTENESS OF THE CONTENT, OR THAT ANY ERRORS IN THE CONTENT WILL BE CORRECTED. THE SITE AND THE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

LIMITATION OF LIABILITY

IN NO EVENT WILL THE DV BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES ARISING OUT OF (I) THE USE OF OR INABILITY TO USE THE DD APP(S), OR THE CONTENT, (II) ANY TRANSACTION FACILITATED BY THE DD APP(S); (III) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE DD APP(S) AND THE CONTENT, (IV) ANY OTHER MATTER RELATING TO THE SITE OR THE CONTENT, EVEN IF THE DV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE, THE CONTENT, OR WITH THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE DD APP(S).

INDEMNIFICATION 

You understand and agree that you are personally responsible for your behaviour in the DD App and site. You agree to indemnify, defend and hold harmless the DV, and their officers, directors, employees, affiliated companies, business partners, licensors, directors, agents, and/or any third party providers from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and legal attorneys' fees, in any way resulting from or arising out of your use, misuse, or inability to use the DD App(s) or the Content, or any violation by you of this Agreement.

FEEDBACK

If you provide the DV/DD any suggestions, comments, questions or other feedback ("Feedback") through the sites' Contact Us forms or otherwise, and relating to DD or sites, the DV may freely use such Feedback towards its DD App(s) products and business. In submitting Feedback, you agree that: (i) the DV is not subject to any confidentiality obligations with respect to the Feedback, (ii) the Feedback provided is not confidential or proprietary information and (iii) you are not entitled to receive any compensation or re-imbursement of any kind from the DV in respect to the Feedback.
